How negotiable is the contingency fee for a potentially major malpractice case?

from what I read the settlement amount varies greatly ...if it caused you to get surgery and if you got a certain illness from it.. .....i've also read only a few cases has been settled out of thousands but then again it depends on the diagnosis and if you got surgery from it...I believe that's crucial for this case...
